1. Acceptance of Terms
By using askjaqq.ca (the “Site”), you explicitly agree to these Terms & Conditions and our Privacy Policy. If you do not agree with these terms or the Privacy Policy, then do not use the Site.
2. Platform Purpose
AskJAQQ is a technology platform that connects users with licensed Alberta family lawyers (“Participating Lawyers”) for legal consultations.
3. No Legal Advice from AskJAQQ
- AskJAQQ is NOT a law firm and does NOT provide legal advice.
- Lawyers participating on AskJAQQ provide legal information in response to the questions asked but this is NOT legal advice and does NOT replace legal advice.
- Any legal advice you receive from the Participating Lawyer you communicate with should only come after taking the step to form a Lawyer-Client Relationship with the Participating Lawyer and AskJAQQ is not a party to that process nor liable from any outcomes resulting from that relationship.
4. Lawyer–Client Relationship
By using the Service, you acknowledge and agree that no attorney-client relationship is formed between you and AskJAQQ, the web or mobile application, or any individual providing information through the platform.
- The information provided by the Service is for general informational and educational purposes only.
- It is not intended to be a substitute for the specialized advice of a licensed legal professional.
- The Service does not perform the services of an attorney, and your use of the Service does not make you a client of AskJAQQ or of any attorney.
- A lawyer–client relationship may be formed only between you and the Participating Lawyer, subject to their professional obligations and engagement terms.
- AskJAQQ is not a party to this relationship and has no responsibility for the advice provided.
- Participating Lawyers are independently regulated by the Law Society of Alberta and are vetted to ensure they are in good standing, but individuals should do their own due diligence and research before formally engaging in a lawyer-client relationship.
5. Ownership of Submitted Content
- All questions, text, documents, and other materials you submit become the property of AskJAQQ.
- Information transmitted to the Service, including questions, comments, and any personal data you submit, is NOT protected by attorney-client privilege or any duty of confidentiality and therefore should not include sensitive, proprietary, or confidential details.
- We do not sell your submitted content to third parties.
6. Acceptable Use
You agree not to:
- Submit false or misleading information
- Post content infringing on intellectual property or privacy rights
- Use the Site for unlawful purposes or to harass others
- Attempt unauthorized access to our systems
7. Limitation of Liability
To the maximum extent permitted by law:
- AskJAQQ is not liable for the accuracy, quality, or outcome of legal information provided by Participating Lawyers.
- AskJAQQ is not responsible for any damages resulting from your reliance on information provided through the Site.
- Your reliance upon any information obtained through the Service is solely at your own risk.
- We expressly disclaim all liability for actions taken or not taken based on any information or content of the Service.
Notwithstanding the above, in the event a court of competent jurisdiction finds AskJAQQ liable for any damages arising out of your use of the Service, your sole and exclusive remedy shall be limited to the amount of money you actually paid to AskJAQQ in the twelve (12) months preceding the date the claim arose.
This total liability is specifically capped at the lesser of:
- The total User Fees paid by the user in the preceding 12 months; OR
- One Hundred Canadian Dollars ($100.00 CAD).
- You specifically acknowledge that AskJAQQ would not offer the Service to you without these limitations.
8. Indemnification
You agree to indemnify AskJAQQ against claims arising from your use of the Site and for any claims against any of the lawyers you have participated with from your use of the Site.
You also agree to defend, indemnify, and hold harmless AskJAQQ, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms and Conditions or your use of the Service, including, but not limited to:
- Your violation of any applicable law or regulation.
- Your misuse of the Service’s information or reliance upon it for legal action.
- Any claim that your user-generated content (including questions or comments) infringes or violates the intellectual property rights or other rights of a third party.
- Your negligence or willful misconduct while using the Service.
AskJAQQ reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with AskJAQQ in asserting any available defenses.
9. Intellectual Property
All Site content (excluding User Content) is the property of AskJAQQ or its licensors and is protected by Canadian and international intellectual property laws.
Ownership of Company Content
- You acknowledge that the Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by AskJAQQ, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
- You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as generally permitted through the Service’s normal functionality.
User-Generated Content (UGC) and License Grant
This section applies to all questions, answers, comments, and other content you submit to the Service (“User Content”).
- User Ownership: You retain all ownership rights in your User Content. AskJAQQ does not claim any ownership rights in your User Content.
- Required License Grant: By submitting, posting, or displaying User Content on or through the Service, you grant AskJAQQ a worldwide, non-exclusive, perpetual, royalty-free, fully paid-up, transferable, and sublicensable license to use, reproduce, modify, perform, display, distribute, and otherwise disclose your User Content for any purpose related to operating, promoting, and improving the Service.
- This includes the right to:
- Publish your questions and the associated answers publicly on the web application.
- Use your content in marketing, advertising, and promotional materials for the Service.
- Modify your content for clarity, formatting, or to remove personally identifiable information.
- Warranties on User Content: By posting User Content, you represent and warrant that:
- You are the sole owner of all rights in and to your User Content or have all necessary rights to grant the license set forth above.
- Your User Content does not violate the rights of any third party, including, without limitation, any intellectual property or privacy rights.
- Waiver of Moral Rights: To the extent permitted by law, you also waive any moral rights of attribution and integrity with respect to your User Content.
10. User Fees
All User Fees are collected by AskJAQQ and then donated to a designated charity of our choosing and therefore the fees for questions asked are non-refundable.
No User Tax Deduction: You acknowledge that the User Fee is a payment to AskJAQQ for platform access. You are not making a direct charitable donation, and therefore, you are not entitled to a charitable tax deduction for the User Fee.
Finality of Payment: All Access Fees paid are final and non-refundable.
No Exceptions: AskJAQQ does not issue refunds for any reason, including but not limited to dissatisfaction with the Service, technical issues, or termination of your account. By paying the fee, you agree to this non-refundable policy.
11. Apple Subscription Terms
- Payment will be charged to your Apple ID account at the time of purchase.
- Your subscription automatically renews unless you cancel at least 24 hours before the end of the current period.
- Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage or cancel your subscription at any time by going to your Account Settings in the App Store after purchase.
- Free trials, if offered, will automatically convert to a paid subscription unless cancelled at least 24 hours before the end of the trial period.
- Any unused portion of a free trial period will be forfeited when you purchase a subscription.
- All billing is handled by Apple, and refunds must be requested through Apple Support.
12. Termination
We may suspend or terminate your access to the Site without notice if you violate these Terms.
13. Governing Law
These Terms are governed by the laws of Alberta, Canada. Any disputes will be heard in Alberta courts.
14. Changes to These Terms
We may update these Terms at any time. The “Effective Date” will reflect the latest version. Continued use of the Site indicates acceptance of updated Terms.
